Application of Terms
A.) All purchases of products from our Bouhdy Art Store are governed by these Terms of Sale. By ordering products from our store you agree to be bound by these Terms of Sale.
B.) We reserve the right to change these Terms of Sale at any time, however, such changes will only apply to orders accepted by us after that time.
C.) Our Terms of Use also apply to your use of our store.
Terms of Use
1. These Terms of Use govern the use of any website owned or operated by Bouhdy Art LLC. By accessing or using any such website (“Site”), you agree to be bound by these Terms of Use. If you do not accept these Terms of Use, you must refrain from using the Site.
2. Bouhdy Art reserves all its intellectual property rights in relation to this site and in
relation to all of the products promoted or offered for sale on the site.
3. Bouhdy Art will not be responsible for and shall not be liable for any damages or loss that you may suffer if any viruses infect your computer or other equipment following your access to, use of, or browsing on this site. Bouhdy Art will take all care to avoid viruses, but has no liability to you if you inadvertently suffer damage from such a virus.
4. Bouhdy Art will endeavour to keep the site current but give no warranty that the
products you wish to buy on the site will always be available.
5. Bouhdy Art may change these Terms of Use from time to time as necessary. If
Bouhdy Art does so, we will post the revised Terms of Use on the Site. Amendments will be effective immediately upon publication on the Site. Your continued use of the Site following such amendment will represent an agreement by you to be bound by the Terms of Use as amended.
6. These Terms of Use are governed by the laws in force in the State of Pennsylvania, U.S.A. You agree to submit to the exclusive jurisdiction of the Courts of Pennsylvania U.S.A.
Orders
An order placed by you within our store is an offer to purchase a product from us. You may not cancel an order once it has been submitted.
Cancellation due to Error
You acknowledge that despite our best efforts, products may be displayed with incorrect pricing or other information, or may be out of stock, due to an error or oversight. In such circumstances we reserve the right to cancel an accepted order at any time prior to delivery, in which case any payment received will be refunded.
Pricing
The prices of products and delivery will be as specified within our store at the time of placement of your order. Those prices include applicable sales tax as applied at check out. All pricing is in USD.
Delivery
Any delivery dates specified within our store and/or in any communication by us to you are estimates only. While we will use our best endeavors to meet such dates, we will not be liable to you for any failure to do so.
Returns
A.) For Prints: We cannot accept returns due to change of mind but in the unlikely event of defects in quality we will of course provide a full refund on return of the print.
B.) For Originals: You have seven (7) days from delivery to advise us in writing that you would like to return the artwork. The artwork must be returned in its original packaging and in the same condition as when it was shipped. It is important, therefore, to take care when both unpacking and repacking your artwork. If these criteria are satisfied, we will issue a full refund minus shipping cost.
General If any provision of these Terms of Sale is unenforceable for any reason, such provision shall be severed from these Terms of Sale and the remaining Terms of Sale will remain in full force and effect.
These Terms of Sale are governed by the Laws of Pennsylvania, U.S.A. You agree to submit to the exclusive jurisdiction of the Courts of Pennsylvania, U.S.A.
